MEDIATION – Consists of bringing a neutral third party into the dispute in an effort to assist the parties to voluntarily settle the dispute. Some local courts require mediation to take place before a case can be brought to trial. Most cases are settled through Mediation. ARBITRATION – Typically in Arbitration, the disputing parties agree to bring the dispute to a neutral third party, the arbitrator, who has the power to impose an award and declare one party as the winner of the dispute. Each party is allowed equal time to present their side to the arbitrator and after deliberation the arbitrator issues a decision. Arbitration decision can be binding or non-binding.
